TERMS & CONDITIONS- CIRCLE K EUROPE CARD

1. DEFINITIONS

 

Account: Account with the issuer used by one or more Circle K cards.

 

Account holder: Natural or legal person(s) that has been granted an account upon application.

 

Cardholder: Natural person in whose name the Circle K card is issued.

 

Card: Circle K EUROPE card; physical, virtual or both. Circle K cards can be used to purchase all product types or a defined group of product types at Circle K filling stations, at INGO filling stations, from car park operators, on toll roads, certain bridges and ferries, and at ROUTEX stations. Circle K has also entered into roaming partnerships for a number of charging stations in Denmark. You can read more about our partnerships at www.circlek.dk/erhverv. 

 

Issuer: Circle K Danmark A/S, CVR no. 28142412 for national use and Circle K International Card Centre AB (Circle K ICC), org. no. SE 556445-9013 for international use (hereinafter jointly referred to as "Circle K").

 

Virtual card: The virtual card is a digital payment method ordered from Circle K's customer portal and added to a Circle K app for a mobile device such as a mobile phone. Any differences in how physical and virtual cards are handled will be clearly described. 

2. CARD USAGE OPTIONS

 

2.1 GENEREAL

The cardholder undertakes to use the card solely for business purposes.
 

 

2.2 CARD TYPES AND USAGE OPTIONS

 

 

2.2.1 CIRCLE K EUROPE CARD

A Circle K EUROPE card can be used at all Circle K and INGO filling stations, and with Circle K's roaming partners in Denmark. 

The card can also be used at more than 21,000 filling stations across 34 European countries. Read more about the ROUTEX partnership at www.routex.com. 

For purchases in Denmark, Circle K Danmark A/S is the vendor of the products and assumes full product liability. For purchases outside Denmark, Circle K International Card Centre AB (Circle K ICC), Stockholm, is the commission agent for the vendor.

Any payment service is provided by Circle K Danmark A/S as payment service agents for Circle K Norge AS. Circle K Norge AS is liable for payment services with regard to account holders.
In Circle K's online self-service facility, Card E-Services, a card can be limited geographically, for example to be valid only in Denmark.

Product restrictions associated with the card can be specified through Card E-Services.

In addition to purchases at filling stations, the card can also be used to pay for certain road, motorway, bridge and tunnel tolls, ferry tickets (except for ferries in Danish waters) and emergency servicing, including repairs.

 

Ferry tickets can also be purchased using Telepass EETS, AutoPASS box or BroBizz linked to a card.

3. TERMS AND CONDITIONS RELATED TO OWNERSHIP AND USE OF THE CAR

 

3.1 NAME AND PIN ON THE CARDS

Cards are issued in a person’s name. If desired, a card can be issued in the cardholder's name as well as the account holder's name. A card can also be registered to a vehicle registration number or other designation instead of a name. In any event, the account holder is liable for purchases made with the card.


All cards are issued with a PIN. Unless a PIN is selected when ordering a card in Card E-Services, it will be sent by post.

Your PIN must be kept secret to prevent misuse. Circle K does not know your PIN.


Once issued, the PIN can be changed to a PIN of your choice via Card E-Services or at any Circle K filling station, INGO filling station or Circle K Truck service station in Denmark. Sequential or reverse sequential PINs, e.g. 1234 or 4321, are not allowed. Furthermore, four identical digits, such as 2222, are not allowed.
 

In order to change a PIN, a purchase is necessary with the existing PIN before it is possible to change the PIN again. However, this does not apply to the first PIN for new cards ordered in Card E-Services without a PIN.


Purchases with a card can only be made by presenting the card and using the PIN or signing the receipt. The point of sale may require proof of identity. Card purchases at vending machines can only be made using a PIN. The same applies to purchases at Circle K and INGO filling stations outside Denmark and at filling stations in the rest of Europe. Purchases of electricity at Circle K filling stations in Denmark, as well as purchases at certain bridges, tunnels, car parks and other locations, can be made without using a PIN or signing a receipt.

 

Cards issued in the cardholder's name can only be used by the person whose name appears on the card. Cards registered to a car registration number can only be used by the cardholder for purchases for the car whose number is on the card.
 

Further purchases with the card will be blocked if an incorrect PIN is entered more than three times. The PIN can be cleared in Card E-Services, where a new one can also be selected.

 

 

3.2 PURCHASE PROFILES

Circle K reserves the right to reject purchases that exceed the card's associated purchase profile.

You can view and select your own purchase profile in Card E-Services. You can also contact Circle K Customer Service to find out what restrictions apply to a card.


Maximum amounts per week and month are calculated per current week and month, see section 9.
Once the maximum amount per day, week or month, or the maximum number of transactions, has been reached, it will not be possible to finish refuelling, as the pump will be disconnected. Once the purchase profile maximum has been reached, the card will subsequently be declined.
The validated amount will be the pump price or retail price for other items including VAT, i.e. the price on the receipt. The amount is before any discount is deducted.
Charging transactions are not included in the amount limits.

It is possible to reopen a card instantly by changing the card's settings in Card E-Services or via Customer Service.

 

Circle K also reserves the right to refuse payment with a card for purchases that result in the credit limit set in section 6 being exceeded, as well as in cases where there is reasonable suspicion of misuse of a card.
Circle K reserves the right to adjust purchase profiles in general and within specific product groups. Changes will be published on www.circlek.dk.

3.3 LIABILITY AND RESPONSIBILITY RULES

 

When a card is first used, it becomes active.
A card should be stored securely, for example in a wallet or bag – never left in a car and never together with the PIN.  The cardholder must regularly check that the card is still in its proper place.

 

If mobile payment is activated via Card E-Services, the Circle K Pro app may only be downloaded and used by an authorised cardholder. Violation of this will be considered a material breach of the terms and conditions.
A card may only be assigned and used on devices with an automatic screen lock and a user verification requirement to open the device.

 

If the physical card or the phone with the linked card is lost or the cardholder suspects that an unauthorised person has gained knowledge of the code, it must be blocked immediately in Card E-services or reported by phone to Circle K on 70 10 101 (24 hours a day). Further purchases with the card will then be blocked electronically.
Theft, misuse or suspicion thereof must be reported to the police without delay.

 

The account holder is liable for any purchase made using the card, regardless of whether the purchase exceeds the above purchase limits or the credit limit set for the card in accordance with section 6. However, unless the cardholder has acted fraudulently, Circle K is liable for purchases made after the card has been reported stolen/lost/stopped by the cardholder or account holder. The account holder therefore remains liable for purchases already made that have not yet been registered on the account at the time of notification to Circle K.


Circle K also reserves the right to reject purchase transactions in the event of reasonable suspicion of unauthorised use of a card.

 

If the account holder or cardholder requests that a card be temporarily blocked, the card is electronically blocked for all purchases except road tax and/or tolls in Denmark and abroad. If such products are purchased while the card is temporarily blocked, the account holder is liable for those purchases.


Use of a card in accordance with the above is considered as acceptance of the goods received and forms the basis for invoicing.

3.4  OTHER TERMS AND CONDITIONS

 

Circle K reserves the right to change and differentiate the discount granted at any time for purchases at the individual Circle K filling stations, Circle K Truck service stations and INGO filling stations as well as the discounts granted at stations designated by Circle K's ROUTEX partners at any given time.

 

Circle K also reserves the right to change the fees charged in accordance with section 5 at any time.


When a card is used at a Circle K filling station or at an unmanned filling station (INGO) to purchase fuel in Denmark, the price will be Circle K's list price applicable at the given time, less the discount agreed between the account holder and Circle K.


If the pump price is lower than the list price less the discount agreed between the account holder and Circle K, the price to be paid by the account holder will be reduced to match the pump price.
The above terms can be deviated from in individual agreements between the account holder and Circle K and in agreements between associations and Circle K. The price basis will typically be Circle K's list price.
Circle K's current list price is published regularly on www.circlek.dk.


The account holder is aware that the price stated in a receipt issued at the time of purchase is the pump price and may therefore differ from the price to be paid. A receipt is not valid as an invoice.
When purchasing diesel in some countries, the list price is invoiced regardless of the pump price. In all other countries, the current pump price is invoiced. When purchasing petrol, the current pump price is invoiced in most countries.

3.5 CHARGING

 

Circle K’s pricing structure

 

When a card is used at one of Circle K's own charging stations, at a Circle K filling station in Denmark, to purchase electricity, the price will be Circle K's list price for electricity applicable at the given time, less any charging discount agreed between the account holder and Circle K, unless otherwise agreed. The discount will be subject to change based on changes in the consumption and purchase of electricity.
Circle K's current list price for electricity is published regularly on www.circlek.dk.


The price is quoted per kilowatt hour (kWh). The price quoted is the total price to be paid and includes all taxes and duties, but not discounts.
A receipt or slip for electricity charging is not issued at the charging station, and it is not possible to use the invoice to apply for a refund of electricity charges.

 

E.ON’s pricing structure

 

When a card is used at one of E.ON's Danish charging stations to purchase electricity, the price will be as per a fixed price agreement, which can be viewed at www.circlek.dk/erhverv at any time, without deduction of any discount on charging agreed between the account holder and Circle K, unless otherwise agreed.

The price is quoted per kilowatt hour (kWh). The price quoted is the total price to be paid and includes all taxes and duties, but not discounts.
A receipt or compliment slip for charging is not issued at the charging station, and it is not possible to use the invoice to apply for a refund of electricity charges.

 

A Circle K EUROPE Card with a charging symbol is required to purchase electricity. However, it is only possible to purchase electricity with the card at Circle K charging stations and Circle K roaming partners' charging stations in Denmark.
Electricity charging does not require the use of a PIN, and it is not possible to enter km, driver and car ID when using the card for electricity charging.
Circle K is not liable for any damage, loss or inconvenience caused to the customer as a result of a charging station being out of service or not functioning properly.
The terms only apply to use, payment and invoicing at Circle K's and its roaming partners' charging stations in Denmark.

4. PAYMENT FOR PURCHASES 

 

Purchases made are shown on the invoice, which is generated to the account holder by the 5th working day of each month, unless otherwise agreed. The balance due date will be stated on the invoice. Complaints regarding the invoice must be made within three months.


For international purchases, a separate statement/specification (VAT invoice) is generated from Circle K International Card Center AB, Stockholm (Circle K ICC). The statement/specification can be used to reclaim VAT.
Payment can be registered with Leverandørservice. Invoices sent by post will be subject to a collection fee, currently DKK 19.00. The collection fee is currently DKK 0 for invoices sent by e-mail.


If payment is made after the payment due date, default interest of 1.25% per month will be charged.

 

For using the card to pay for road, motorway, bridge and tunnel tolls, ferry tickets and emergency servicing, including repairs etc. in certain countries, the fee rates set by Circle K at any given time will be charged. A currency conversion surcharge of up to 1% of the purchase amount including VAT will be charged for using a card abroad.


Any complaints regarding the purchase of ferry tickets must be made to Circle K Customer Service, which will then forward the complaint to Circle K ICC.

6. CREDIT ASSESMENT

 

Circle K reserves the right to perform a credit rating check based on information obtained from a credit reference agency recognised by the Danish Data Protection Agency and to obtain other publicly available information. See also section 8. On the basis of this credit rating, Circle K reserves the right to refuse credit without further justification.

When applying for a card, expected spending must be stated as a basis for the credit rating. If the declared spending is significantly exceeded, further purchases made using the card may be declined. Reactivation of the card will be subject to a new credit rating.

7. PROCESSING DATA COLLECTED

 

Circle K is the data controller if Circle K receives personal data from the cardholder or account holder.


The personal data processed by Circle K includes the personal data provided in connection with the application, including name, address, telephone number, e-mail address, CPR number (sole traders and partnerships), purchase information and other personal data that the cardholder or account holder may voluntarily disclose in connection with the customer relationship.


Circle K processes personal data to create and manage a customer relationship with Circle K.


Information about purchases etc. will be recorded and used primarily to execute or adjust payment transactions.

 

Information provided on the application form and any other information obtained in connection with the issuing of a card will be stored by Circle K for the duration of the account relationship. Receipts signed by the cardholder will be stored for a minimum of six months. Copies of account statements will be stored electronically for five years, and the information contained in these statements, together with any adjustments, will usually be stored electronically for the same period.

 

When submitting amounts owed for legal debt collection, the RKI Credit Information and Debtor Register will be notified, stating name, address, CVR no. and amount. In this connection, Circle K may use a debt collection partner to collect the account holder's debt who will thereby be provided with the necessary information for making collection. Communication between the account holder and Circle K, including Circle K's debt collection partner, may take place digitally, for example via e-mail using the e-mail address provided by the account holder. Furthermore, recorded data will be disclosed to public authorities in accordance with the law, for example the Danish Tax Control Act.

 

Circle K's processing of personal data is otherwise in accordance with Circle K's privacy policy, which you can read at www.circlek.dk/erhverv.

8. CHANGE OF NAME AND ADDRESS

 

Name changes must be notified in writing to Circle K in a form sent via www.circlek.dk/erhverv.


A new CVR no. in connection with a new name and/or company form will require the completion of a new application form and thus the creation of a new account and the issue of a new card.

 

Changes of address may be made in writing at www.circlek.dk/erhverv. 

9. BLOCKING OF CARDS AND DECLINING OF CARD PURCHASES

 

Cards will be blocked if reported stolen or lost, or if there is a risk that the PIN has been disclosed to unauthorised persons. They will also be blocked when the payment card agreement is cancelled.

Cards may also be blocked if the agreed terms and conditions regarding purchase limits or credit limits are not observed.


In addition, Circle K reserves the right to block the card if there is reasonable suspicion of misuse, e.g. when extensive purchases are made on the card within a very short period of time that are not part of the cardholder's normal spending pattern.


Finally, the card will be blocked if the account holder enters into company restructuring, goes bankrupt or moves to a permanent address outside Denmark.


In addition, purchases with the card may be declined if: 1) an incorrect PIN is entered more than three times; 2) the purchase limits in section 3.2 are not observed; 3) the credit limit set for the account holder is exceeded; or 4) the account holder is registered in the RKI Debtor Register or a similar register.


If a card has been inactive for a minimum of 12 months, it may be cancelled by Circle K without notice. However, the customer relationship will not end and a replacement card can be ordered by contacting Circle K.
 

10. CANCELLATION OF PAYMENT CARD AGREEMENT AND CHANGE OF CARD TERMS AND CONDITIONS

 

The account holder can cancel the card agreement at any time and without notice.


Circle K reserves the right to cancel the card agreement or change the card terms and conditions with two months' notice. However, Circle K reserves the right to make changes that are not unfavourable to the account holder without notice.
 

If a cardholder uses the card after the notified effective date of the change, this is considered as acceptance of the change by the account holder.
 

Should the change be of particular importance, the account holder will be informed.

11. EXPIRY AND RENEWAL

 

The card has an expiry date. It is automatically renewed approximately one month before expiry if the account holder has used the card within the six months prior to the renewal date and if the cardholder does not cancel the account agreement.

All card types are valid for five years.

12. SUPERVISORY AUTHORITY AND RIGHT OF APPEAL

 

As an agent for Circle K Norge A/S, Circle K is subject to supervision by the Norwegian Financial Supervisory Authority.
